Effective September 30, 2003, per Michigan DUI law, the legal Blood Alcohol Content for a drunk driving charge was reduced from a level of 0.10 grams or more to a level of 0.08 grams. The name of the offense has now been changed to Operating While Intoxicated/Impaired (OWI). While there is no longer a presumption that will help you in your defense against a drunk driving charge; there is now a presumption that will hurt you. If you have a BAC of 0.08 grams or more, then you are presumed to be intoxicated. Failure to take a breathalyzer test (the Datamaster) can have serious consequences, such as a 1-2 year driver's license suspension. A hardship license to drive to work and school can be obtained in certain circumstances.
