When it comes to crimes that fall under the broad category of "child molestation," the sentences are among the most serious of all sex crimes. Depending on the nature of the charge, it will fall under one of four degrees.
Criminal Sexual Conduct (CSC), First Degree, carries with it a possible mandatory minimum of 25 years in prison, lifetime tether and sex offender registration.
Criminal Sexual Conduct (CSC), Second Degree, may also result in up to 15 years in prison, possible lifetime tether and mandatory sex offender registration.
Criminal Sexual Conduct (CSC), Third Degree, is punishable by a possible 15 years in prison and sex offender registration.
Criminal Sexual Conduct (CSC), Fourth Degree, is punishable by up to 2 years in prison and sex offender registration.
CSC First and Third degrees involve offenses of penetration, which includes oral sex. CSC Second and Fourth degrees involve offense of sexual contact. Convictions for any of these offenses require sex offender registration but our team of sex crime attorneys is aware of several ways to attempt to avoid sex offender registration. The sex offender registration is only part of the problem. Problems regarding the Student Safety Zone or 100-foot rule will also pose problems for those placed on SORA.
